Terms of Service.

These Terms of Service (“Terms”) govern your use of estebansconcrete.com (the “Site”), the services provided by Esteban’s Concrete (“Esteban’s Concrete,” “we,” “us,” or “our”), and your participation in the Esteban’s Concrete SMS Messaging Program.

By accessing the Site, requesting an estimate, submitting a form, signing an agreement, or opting in to receive text messages, you agree to these Terms.

1. Estimates and Concrete Services

Estimates provided by Esteban’s Concrete are free and are provided for informational purposes unless otherwise stated.

Pricing, project scope, materials, schedules, payment terms, warranties, and other project details are not binding until they are included in a written agreement accepted by Esteban’s Concrete and the customer.

Concrete projects may be affected by weather, site accessibility, soil conditions, utility locations, permitting requirements, material availability, and other circumstances outside our reasonable control. Project dates and completion timelines may therefore change. We will make reasonable efforts to communicate material scheduling changes.

2. Esteban’s Concrete SMS Messaging Program

Program Description

The Esteban’s Concrete SMS Messaging Program allows customers and prospective customers to receive text messages from Esteban’s Concrete regarding concrete estimates, appointments, requested services, active projects, customer support, and promotional opportunities.

Depending on the consent you provide, messages may include:

Responses to estimate or service inquiries.
Appointment confirmations and reminders.
Estimate follow-ups.
Project scheduling and status updates.
Requests for additional project information.
Customer-care and support communications.
Invoice, payment, or service-related notifications.
Follow-up messages regarding completed services.
Promotional offers, discounts, seasonal specials, company news, and other marketing communications.

Marketing consent and non-marketing consent may be collected separately. Consent to receive marketing text messages is not a condition of purchasing any goods or services from Esteban’s Concrete.

SMS Consent

By providing your mobile telephone number and affirmatively opting in, you authorize Esteban’s Concrete to send SMS or MMS messages to the number provided.

Your consent applies only to the categories of messages described in the disclosure presented when you opt in. Messages may be sent using automated technology or through the GoHighLevel customer relationship management platform.

You represent that you are the subscriber, account holder, or customary user of the telephone number provided and that you are authorized to provide consent for that number.

Message Frequency

Message frequency varies depending on your interactions with Esteban’s Concrete, the services you request, and whether you consent to promotional messages.

The SMS program may include recurring messages.

Message and Data Rates

Message and data rates may apply.

Your mobile carrier’s standard messaging, data, and other charges may apply to messages sent or received through the SMS program. Please contact your wireless provider for information about your mobile plan.

How to Opt Out

You may cancel SMS messages at any time by replying STOP to any message from Esteban’s Concrete.

After you text STOP, you may receive one final confirmation message stating that you have been unsubscribed. After that confirmation, you will no longer receive text messages from the applicable SMS program unless you provide consent again.

Where supported, similar opt-out keywords such as CANCEL, END, QUIT, REVOKE, OPT OUT, or UNSUBSCRIBE may also be recognized. Replying STOP is the recommended method.

Opting out of marketing messages does not prevent Esteban’s Concrete from contacting you through other lawful methods or from sending essential communications when otherwise permitted or requested.

Carrier Disclaimer

Wireless carriers are not liable for delayed, blocked, filtered, or undelivered messages.

Message delivery is subject to effective transmission by your mobile carrier and is not guaranteed by Esteban’s Concrete. SMS services may not be available through every carrier or on every device.

Age Restriction

The Esteban’s Concrete SMS Messaging Program is intended only for individuals who are 18 years of age or older.

By opting in, you confirm that you are at least 18 years old and are legally capable of agreeing to these Terms.

Supported Carriers and Device Requirements

You must have a text-message-capable mobile device and an active wireless service plan to participate. Availability may depend on your carrier, device, service area, and mobile plan.

Privacy and Mobile Information

Your participation in the SMS program is also governed by our Privacy Policy:

Mobile information, including telephone numbers, SMS opt-in records, and messaging consent, will not be sold, rented, or shared with third parties or affiliates for their own marketing or promotional purposes.

Information may be shared with service providers that help us operate our communications, website, CRM, scheduling, customer-support, or messaging systems, but only as necessary to provide those services on our behalf.

SMS consent is not shared with third parties or affiliates for marketing or promotional purposes.

3. Changes to the SMS Program

Esteban’s Concrete may modify, suspend, or discontinue all or part of the SMS program at any time.

We may also update the telephone number, messaging platform, message content, or program features used to operate the program. Changes will not eliminate your right to opt out by replying STOP.

4. Website Content and Acceptable Use

The photographs, videos, text, graphics, logos, branding, designs, and other materials displayed on the Site are owned by or licensed to Esteban’s Concrete.

You may not copy, reproduce, distribute, publish, sell, modify, scrape, or reuse Site content without prior written permission.

You agree not to:

Interfere with the Site’s operation or security.
Attempt to gain unauthorized access to the Site or its systems.
Submit false, fraudulent, misleading, or unauthorized information.
Use automated tools to scrape or collect information from the Site.
Use the Site for unlawful, abusive, or harmful purposes.

Although we make reasonable efforts to provide accurate information, Esteban’s Concrete does not guarantee that the Site will always be uninterrupted, error-free, secure, or current.

Website content, general pricing information, photographs, project examples, and preliminary estimates do not replace the terms of a signed project agreement.

7. Limitation of Liability

To the maximum extent permitted by applicable Texas law, Esteban’s Concrete will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages arising from or related to your use of the Site or participation in the SMS program.

Nothing in these Terms limits any rights, remedies, obligations, warranties, or liabilities established under a separate written construction or service agreement signed by Esteban’s Concrete and the customer.

8. Indemnification

You agree to indemnify and hold harmless Esteban’s Concrete and its owners, employees, contractors, agents, and service providers from claims, damages, losses, liabilities, and expenses arising from your misuse of the Site, violation of these Terms, submission of unauthorized contact information, or violation of another person’s rights.

9. Governing Law

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles.

Any dispute relating to the Site or these Terms will be handled in a court of competent jurisdiction located in Bexar County, Texas, unless another location is required by applicable law or a separate signed agreement.

10. Changes to These Terms

We may update these Terms periodically to reflect changes in our services, messaging practices, legal requirements, or business operations.

The updated version will be posted on this page with a revised “Last updated” date. Your continued use of the Site or SMS program after an update constitutes acceptance of the revised Terms to the extent permitted by law.
